AT&T is laying down the hammer for anyone abusing their grandfathered unlimited data plans. Their latest tactic may be more justified than their plan to throttle data, but is surely disheartening to many iPhone users nonetheless.
If AT&T finds out that you're using the iPhone's Wi-Fi hotspot capabilities without paying for plan via jailbreaking, they'll give you a warning and a slap on the hand. If you continue your behavior, they will revoke your unlimited plan, toss you into a tiered plan, and start charging you for hotspot capabilities.
According to 9to5 Mac, AT&T will begin taking action as early as August 11, but AT&T has stated that the actual enforcement will vary depending on when the user gets their first warning.
