The legal battle between the Infinity Ward founders and Activision continues to roll on. A new cross complaint was filed late last week by Jason West and Vince Zampella, adding new allegations against the Call of Duty publisher.

First reported by Kotaku, West and Zampella now accuse Activision of Fraud, saying the company made promises it never planned on keeping during contract negotiations in 2008. The duo claim Activision promised them creative authority over any game developed under the Modern Warfare label and any Call of Duty title set in the post-Vietnam era, the near future, or the distant future. West and Zampella allege that in 2008, Activision began "secret development of Modern Warfare and Call of Duty games and related products" without their approval or input.

West and Zampella later accuse Activision of planning their termination from the company even before Call of Duty: Modern Warfare 2 was shipped. During their negotiations, Activision CEO Bobby Kotick is quoted as saying, "Don't worry about it. It's impossible for you guys to get fired."

A trial date has currently been set for May 23, 2011. West and Zampella are seeking upwards of $36 million.
