I think you would be overpaying if the average price for a game of a certain production quality (indie or AAA for example), is above the others by a fair margin. The pirating argument is basically saying anyone can pirate if they are smart enough. It doesn't really rely on price, but however it feels more justified to attach price to your reasoning. Even for a leisure item that costs them nothing to distribute. Maybe profiting off cheap distribution is a little bit too justified.
