I believe Nintendo games bought and downloaded from the eShop and installed onto the SD card or the 3DS remain on the system and still work even if such an event as Nintendo's servers going down happens(unlike PSN/Xbox Live or other such downloaded games), I just need confirmation of this.
So, will my games stay with me even if there comes a day that Nintendo servers and their eShop are gone? Or will they go like any other digital game?
Well if the eShop server closes I can't guarantee that any of us can re-download any games at all. But as we all can see, the digital era is here to stay. Even after eShop Nintendo will replace the store with a new one, and will work on migrating your status over.

Thank you for replying, but what I want to know is: Say that Nintendo is gone, they've decided to finish with consoles(this is just an example), will the games I bought off the 3DS eShop and saved to my SD still work, or is this gone to be like Sony/Microsoft where I'm just renting the games?
If Nintendo is gone, the you can safely say bye bye to your digital games. Unless Nintendo decides to keep the servers open after they retire or sell their IPs to another game maker.

Ah, thank you for answering. I was wondering if the way it saved to the SD card was different then others, guess not.
I highly doubt they're gonna shut their servers down anytime soon. I mean, the Wii is almost 8 years old, and the Wii Shop channel still works fine for me, I reckon the eShop will live long too.
