The legal battle surrounding Duke Nukem Forever is over.

A Take-Two representative confirmed to IGN this afternoon the company has settled with 3D Realms and has dismissed all litigation surrounding the game. A stipulation of dismissal with prejudice was filed on May 28, 2010, meaning the parties cannot be sued again on the same cause of action.

On May 17, 2009, Take-Two originally sued 3D Realms/Apogee Ltd for breach of contract for continuing to delay the release of the game. 3D Realms responded with a countersuit claim a month later saying Duke Nukem Forever was still in development.

"We can confirm that the matter has been resolved, and the company is not providing additional details of the agreement," said Alan Lewis, VP of Corporate Communications at Take-Two.

A 3D Realms representative told IGN the company is not providing comments on the matter.

It's unclear what this means for the development and eventual release of the game going forward. 3D Realms recently teased a new Duke Nukem announcement last year.

Duke Nukem Forever was first announced back 1997.
