US District Court Judge Vaughn R. Walker certified a national class-action lawsuit to go forward regarding the Madden series. The suit contends that Electronic Arts' exclusive contract to create NFL football games is an "illegal price-gouging scheme" and that gamers who purchased a Madden game, an NCAA Football game, and an Arena Football game after 2005 are entitled to compensation for EA's supposed unfair practices.
The suit was originally filed in June 2008, and contends that EA's deal with the NFL is "blatantly anti competitive conduct." Before the exclusive deal, EA and Take-Two Interactive were seemingly in a price war with their NFL games: Take-Two dropped the price of NFL 2K5 to $19.99 and EA cut Madden 2005's sticker tag to $29.95 in response. With the license in place, and the competition effectively destroyed, the suit alleges that EA then raised the price of its product to its current $59.99
"We believe EA forced consumers to pay an artificial premium on Madden NFL video games," Attorney Hagens Berman said. "We intend to prove that EA could inflate prices on their sports titles because these exclusive licenses restrained trade and competition for interactive sports software."
