Microsoft has been hit with a class-action lawsuit over Xbox Live fees. A Georgia man claims Microsoft improperly allowed his underage son to use his debit card to subscribe to the company's Xbox Live gaming service then automatically renewed the subscription without authorization.

Francisco Garcia is seeking unspecified damages and is asking the court to broaden the case to include all Xbox Live customers in Georgia hit with similar problems.

After Microsoft renewed their yearly subscription price without authorization, Garcia's account was overdrawn, and while Xbox did refund the price of the renewal, they did not compensate him for overdraft charges of $35.

Microsoft responded by asking the federal court to dismiss the case, because, they say, the Garcia's son misrepresented his age when he subscribed to Xbox Live by falsely stating that he was at least 18 years old.
