Nintendo has filed a civil lawsuit against the owner of several websites that sell devices that can play pirated DS videogames.
NXPGAME, Inc. has allegedly been selling devices that "play and distribute illegal copies of Nintendo DS and Nintendo DSi video game software," according to Nintendo. The company says it contacted the owner multiple times before agreeing to take down the website. Shortly thereafter, the owner launched a separate, identical website and continued to sell the devices. The website is also using Nintendo registered trademarks.
Nintendo claims the company is "willfully infringing on the company's intellectual property rights." The company is seeking damages of $150,000 for each copyrighted infringement and $2 million for each Nintendo trademark infringement.
"Using game copiers to play unauthorized downloaded games is illegal and it's wrong," said Jodi Daugherty, Nintendo of America's senior director of Anti-Piracy. "Piracy is especially harmful to smaller developers. When their creative works are stolen and copied illegally, some companies find it difficult to survive economically."
