RPG Maker engine Pokemon Essentials which is used to make fan games like Pokémon Uranium, has been officially shut down thanks to a cease and desist from Nintendo. Kotaku has been informed that by receiving the C&D, all Essential assets like images and sound files have been deleted.
 
Developer policies.
ZUN promotes everyone to make use of his work to make own products, because it promotes the Touhou franchise to a wider audience.
Nintendo absolutely wants to avoid it because it assumes that people will become less likely to buy Nintendo games if they won't.

This is why there are lots of Touhou fan games on many platforms, and are being sold by all sorts of developers and/or publishers.
All while Mario/Pokemon/etc. is mostly limited to only and only Nintendo, plus a couple of fan games distributed for free for PC until getting caught.

The difference is that ZUN is a single man while Nintendo is an as traditional company as it can be; rejects all modern concepts at all costs unless having no other choice than to adapt.
But if you look at how Touhou has become such a worldwide success these days, it's easy to see that Nintendo's logic of "fan games destroy sales of Nintendo software" is completely false.
 
Well Nintendo has the rights. Though for me it don't actually affect the sales but the opposite as it is bringing many audience from different world, also those fan made games do not claim that they own everything. It should be treated as how youtube treating the parody/AMV videos :P
