I never got this. I mean sure, you could say the removal of the old games from the Virtual Console were 'proof' in some twisted way, but... look at all the other evidence suggesting otherwise.
1. The Kremlings and K Rool have appeared in multiple Mario and Donkey Kong spinoffs since Rare left:
Not pictured: Jungle Climber, Barrel Blast/Jet Race, trophies in two Smash Bros titles, Mario Football games or various others.
2. The music appeared remixed in Returns...
And as far as I recall, Rare wasn't credited at all for any of it. Nor was David Wise oddly enough, despite him being the original composer.

Chris: Well, the two properties that go back to Nintendo are Donkey Kong and Star Fox. The rest of the IP actually comes back to Rare. We have a very good relationship with Nintendo it all worked out in the end.
Hence Donkey Kong content = Nintendo property
So where does this myth come from anyway? What author online is going around acting like Rare owns Donkey Kong Country content? Heck, shouldn't the presence of Dixie Kong in Tropical Freeze have sunk a lot of these claims?
