Xbox Live users will be banned for violating Xbox Live's code of conduct in Xbox One's Upload Studio, which may affect the rest of their Xbox One experience. The consequence of the bans  seems to affect Skype functionality, leading some to believe Microsoft is listening in on their voice calls and suspending accounts for swearing during Skype conversations. This is not the case.

"To be clear, the Xbox Live Policy & Enforcement team does not monitor direct peer-to-peer communications like Skype chats and calls," a Microsoft representative tells IGN. "Also, we take Code of Conduct moderation via Upload Studio very seriously. We want a clean, safe and fun environment for all users. Excessive profanity as well as other Code of Conduct violations will be enforced upon and result in suspension of some or all privileges on Xbox Live. We remain committed to preserving and promoting a safe, secure and enjoyable experience for all of our Xbox Live members."

What's likely going on here is Gold account suspensions prevent users from accessing other Gold-enabled features -- this includes Upload Studio/DVR and Skype, as well as online multiplayer.

time to start cleaning up your vocabulary folks.

Empty threat, I'd say. I suppose they probably will ban 10 people or so but there is no way they will enforce this because it'll kill too many sales. When I go online, 1 out of 50 people are ghetto thug wannabes. There is no way they are going to ban 100K users.

Love the English on the warning...
"Because of your past behaviour, you can't Xbox Live Gold is required to use skype on Xbox One."
Almost seems like a joke in itself.

In another article they mention that for M-rated games the filters were off. (Since players of Battlefield 4 could upload videos loaded with profanity.)

So I guess for things like skype and upload studio (on non M-rated games) then the filter was on. Though I don't really think this is a bad thing. I mean too many users are throwing around racial slurs and using more curse words than punctuation (when they write). So this could be a helpful step forward to let them know that such language is not acceptable and that it's time to be held accountable for what they say on XBL.
Especially with their new reputation system too. (Since if people curse a lot then it may affect their reputation and cause them to be dropped in ranking so they only play with other people who talk the same way. Or possibly they may even start off muted or something like Extra Credits suggested?)

Apparently there is no filter on skype now, but it does bring this issue to confusion when the M rated games break Xbox one's own rules. I really think MS was in the bar when making up the Xbox one, due to how sloppy it is. This video outlines the ban a bit better.
