Jury awards Hulk Hogan $115M in sex tape lawsuit against Gawker

Now what is to stop some other broke celeb from leaking their sex tape and then claiming it was stolen so they can sue for money?

Per the First Amendment.. although I am getting tired of people pleading the 1st for things that it really doesn't apply to..

A few years ago, porn stars sued the state of California because of a law they were proposing that would have forced the directors to require condom use in their movies, and periodic HIV, STD testing, in response to the major production shutdown caused by the spread of HIV between two stars who were romantically involved.

Basically the guy got it from someone else (another guy since he was bisexual) outside of filming, (he cheated) did not disclose his status, and withheld it from producers, infected his girlfriend, and she unknowingly ended up infecting someone else on set, who then got sick, got tested and subsequently sounded the alarm. It was also disclosed that the idea that producers test the actors regularly was a myth as many of them don't care enough and aren't willing to pay for it.

This is a myth that has always been floated around in order for producers to allay public concern, after the spread of HIV/AIDS in the 70's and 80's, and if this were true, then it would have been caught sooner, and there wouldn't have been at least 2 more shutdowns after this one.

Anyway, the producers argued that people don't want to see condom use, and forcing the stars to use them would cause a decline and the stars argued that forcing them to use condoms would be in violation of their 1st Amendment rights. Which isn't true because Brazil and other countries mandate condom use in production out of safety of the actors.

During this entire time there was yet another shutdown in production involving a star who got Hep C and didn't disclose his status and infected someone else. And later on there was another shutdown this time involving gay actors.

Initially the courts ruled for the stars and production, but it may have been overturned because in response companies in the industry moved to Florida where there are no restrictions.

Another example is when a woman was sitting on the steps of the Lincoln Memorial in DC, and some pervert took and upskirt photo of her, and although the police arrested him, he sued the claiming that his 1st Amendment rights were violated, and the courts ruled in his favor saying that although he is a pervert, that she had no expectation of privacy because she was wearing a skirt in a public place.

So that is why, in this country, in some states, it is perfectly legal to take upskirt pics of women.. these pics are considered protected speech per the 1st Amendment.

As many times as they do different acts. If gawker had kept poking at Hogan and recording him at home and/or releasing his private conversations then he could keep suing them.

Gawker Media has filed for bankruptcy, according to documents filed today in Southern District of New York Bankruptcy Court. The filing lists the company's assets as between $50 and $100 million, with liabilities as high as $500 million.

The company's finances are still reeling from a judge's ruling in March that fined the company $140 million for publishing a video of Hulk Hogan having sex. While still subject to appeal, that ruling required the company to present a $50 million bond, a sum that significantly exceeded the company's cash reserves.
 
My honest response to this:


Gawker's staff are often such horrible people that I don't pity them losing the entire company. Remember, this is a company that refused to obey the law (including direct court orders), would post sex tapes of kids if it brought money (literally, Denton said the minimum age would be 4), would happily promote bullying against those they don't like and show a massive amount of hypocrisy in general.
 
Exposing other people's shameful moments or mistakes, accidents, etc. for the sake of website traffic for cash, is the same as blood money. It's dirty and shouldn't be tolerated in this day and age.
 
Apparently ZiffDavis (owners of IGN, ExtremeTech and PCMagazine) were looking to buy gawker. If they do I hope they fire all the top staff (for their shitty business practices leading up to the lawsuit) and replace them with better people.
