Two more class action lawsuits have been filed against Sony Computer Entertainment America for removing the 'Other OS' feature from the PlayStation 3.

The first lawsuit, filed on Wednesday, May 5 by Todd Densmore of Cumming, Ga., and Antal Herz of San Francisco, Calif., claim Sony has rendered several PlayStation 3 features they paid for "inoperable" as a result of the release of firmware 3.21. The update, released on April 1, 2010, disabled the ability to install the Linux operating system. By choosing not to update their console, users couldn't access separate, non-related features, such as signing onto PlayStation Network.

The suit states Sony allegedly failed to disclose to customers that it reserved the right to remove advertised, built-in features. The suit also states the right to remove the 'Other OS' feature is not disclosed in Sony's Terms of Service or System Software License Agreement.

Densmore and Herz are seeking damages and other relief the Court deems just. The class includes anyone who purchased a PlayStation 3 from November 17, 2006 to March 27, 2010 and folks who continue to own their console as of March 27, 2010.

The second class action suit, filed on April 30 by five individuals across the United States, claims, among other things, that the plaintiffs "lost money by purchasing a PS3 without receiving the benefit of their bargain because the product is not what it was claimed to be - a game console that would provide both the Other OS feature and gaming functions."

The group is seeking compensatory damages, restitution, and injunction relief.

I say look at it from the view point of us paying for something and then having that something taken away with nothing in return. No matter how big or small something is something is still something.


This is untrue, you will get back increased security according to Sony press releases and continue development of quality games.

If this security exploit is not fixed, developers might not want to make new games for the PS3 since the Other OS security problem can mean it is easier for PS3 to be able to play pirated games or players to hack games and consoles with or without a MOD-Chip.

It is best to deal with Security problems quickly before they get out of hand...

Most game companies these days don't want to make games if they can be easily pirated. They most likely make more games for the Xbox 360, Wii or PC.

Plus, Sony is protecting it's reputation to its developers as having a secure console which is harder to pirate games on.
 
But since they are getting sued so much, there point of view would probably be that "it was stupid because now we are getting into to much annoying things that we would rather not deal with."

removing the OS feature just makes it harder to crack the PS3 but that won't stop it. On top of things Sony has little reputation since PSN can be bought down by a teenager.

This is what Sony gets for hiring cheap unskilled or lazy workers for PSN. Plus, there is a possibility Sony does not even manages PSN. They probably pay some poor company in the 3rd world like India with tons of cheap IT support and development staff.

Cracking the PS3 is illegal in many countries since you are messing with "intellectual property" if Sony finds out they can pursue legal action on hackers like all those people who sold Mod chips online. Plus, few people will want to crack their PS3 since you are voiding the warannty.

But, imagine if someone made a OS for Other OS pack full of pirated games which could be played on the PS3. All those developers which are being ripped off by piracy might decide to boycott Sony for not doing anything to protect their "games" which is what they use to make money.

Sony does not want their consoles to be able to play old ROMs for the SNES, Gameboy, or Genesis since they might see a decrease in PSN sales for older 2D games.
 
You can usually buy a Blu-Ray player made by Sony or Panasonic for 100-150 dollars on Amazon. What a waste if you only use a PS3 for Blu-Ray Movies. Plus, the PS3 does not come with a actual rectangular remote like a TV.
