Seriously Nintendo? Are you really this naive? Not only do you have an account system which presumably records the age of any Nintendo Network account user, but this does as much to deter underage kids from buying M rated games as a lead balloon does at flying.
Really, it kind of falls apart immediately when you consider that:
As an additional precaution to make sure that minors cannot access content which is inappropriate for their age.
Nintendo has always aimed to offer gameplay experiences suited to all age groups, observing carefully all the relevant regulations regarding content access that are present in the various European countries.
So, does everyone else think this is a ridiculous and ineffective policy?

Really, it kind of falls apart immediately when you consider that:
- Kids have days they're allowed to stay up late, even in fairly restrictive families. So I guess they'll have to wait until Summer Holiday, or half term, or Easter, or Christmas, or their Birthday to buy a digital copy of Black Ops 2 or ZombiU.
- Not all kids have a bed time before 11pm.
- Many adults who'd buy or view this content have an actual day job and can't be up between 11pm and 3am because of work related reasons.
- Some adults might do this minor thing called 'night shift', in which they're pretty much screwed.
- Parental controls work as well as a chocolate tea pot.
